The Process
To register a trade mark across the entire European Union, the most efficient method is to file a European Union Trade mark (EUTM) application. This application covers all 27 EU Member States. The registration process typically takes about 4-5 months, so long as there are no objections.
The EUTM provides protection in every EU member state. A single similar trademark in any member state can lead to the rejection or cancellation of your application.

The Process
We would undertake a trade mark search for you to ensure there are no other registered marks that yours may infringe upon, we’ll also provide advice on the likelihood of any objections being raised by the Intellectual Property Office (IPO).
Once complete we will then be in a position to file your trade mark application. The IPO will examine the application, and if there are no issues they raise it will be then published for opposition purposes. At the time of writing, so long as there is no opposition to the application the process is taking approximately 4-5 months.

The procedure for obtaining a trade mark registration in the United Kingdom is currently taking approximately 5 months, but this can vary depending on the amount of applications the Intellectual Property Office (IPO) receive. Key point – Registration is effective from the date of application i.e. the sooner you apply, the better.
No, successful registration in one country doesn’t affect applications in other countries. Each application is assessed independently by the respective IP offices.
For example, if you successfully register in the UK but face opposition in the EU, the EU application might be refused while the UK registration remains valid.
The cost to apply to register a trade mark in the UK is £499 ex VAT for one class. Any additional classes are charged at £120 plus VAT each. With the first year of monitoring the cost in the UK is £649 plus VAT.
In the UK, the opposition window for a trade mark application is two months from the date the application is published in the Trade Marks Journal. This period can be extended by an additional month, providing a total of three months, if a “Notice of Threatened Opposition” is filed within the initial two-month period.
No, it’s not mandatory to register in your home country first.
You can register your trade mark in any country, regardless of your residence. However, you typically need legal representation to file the application. An attorney or legal service can represent you in the trade mark proceedings.
